Welcome to PSco Studios. These Terms & Conditions govern your use of our website, contact forms, booking forms, consultation requests, project inquiry forms, creative services, construction documentation inquiries, digital tech service inquiries, and related digital platforms.

These Terms apply to PSco Studios, our main brand strategy and creative production agency; Build by PSco Studios, our construction-focused branch supporting lifecycle documentation, progress visuals, drone and aerial imagery, project communication assets, proposal support, closeout visuals, and visual documentation systems; and Henry Digitech / Digital Tech by PSco Studios, our digital imaging and production technology service branch supporting on-set capture, file management, tethered workflow, color management, backups, equipment support, post-production workflow, and live streaming services.

By using this website, submitting an inquiry, booking a service, approving a proposal, or working with PSco Studios, you agree to these Terms & Conditions.

1. Definitions

For the purpose of these Terms:

Image” includes any photograph, digital file, video frame, design, artwork, graphic, scan, rendering, illustration, montage, edited media, drone image, still frame, or other visual asset created, captured, edited, delivered, licensed, or offered by PSco Studios.

​

Video” includes motion footage, edited video, raw footage, social media clips, reels, interviews, event coverage, construction progress footage, drone footage, branded content, live stream recordings, and any other moving image content created or delivered by PSco Studios.

​

Creative Assets” include photography, video, graphics, written content, brand strategy materials, visual documentation, social content, proposal assets, design files, edits, layouts, presentations, campaign concepts, project documentation, and related deliverables.

​

Reproduction” includes any form of copying, publishing, posting, printing, sharing, distributing, displaying, editing, storing, uploading, downloading, projecting, presenting, licensing, transmitting, or otherwise using all or part of any Image, Video, Creative Asset, or deliverable, whether altered or unaltered.

“Client” means the person, business, organization, agency, contractor, developer, owner, representative, or entity to whom the proposal, invoice, agreement, or communication is addressed, whether acting on their own behalf or on behalf of a third party.

Services” include photography, videography, brand strategy, creative production, content creation, event coverage, construction documentation, drone/aerial services, project visual asset management, proposal support, digital imaging technician services, tethered capture, production workflow support, equipment support, live streaming, and any other service offered or performed by PSco Studios.

​

Digital Tech Services” include digital imaging technician services, tethered capture, on-set file management, capture station setup, software and hardware troubleshooting, live RAW processing, focus and exposure monitoring, color management, metadata application, backup workflow, image review systems, equipment rental support, post-production workflow support, and live streaming support.

​

Production Technology” includes computers, monitors, cameras, cables, storage devices, networking equipment, capture software, lighting-related technology, backup systems, streaming systems, card readers, drives, routers, switches, carts, cases, and other tools used to support capture, delivery, review, backup, transfer, or streaming.

​

Data” or “Project Files” include image files, video files, RAW files, capture files, edited files, backups, production assets, metadata, folder structures, exported files, live stream recordings, project files, client-supplied files, and related digital materials.

2. About PSco Studios

PSco Studios is a brand strategy and creative production agency combining insight, storytelling, and execution across photography, video, content, and strategic creative services.

​

Build by PSco Studios is a dedicated construction-focused branch created to support construction firms, developers, contractors, owners, and project teams with visual documentation, progress coverage, aerial imagery, project asset organization, closeout visuals, and documentation support that can be used for communication, branding, proposals, stakeholder updates, and project records.

​

Henry Digitech / Digital Tech by PSco Studios supports photographers, production teams, agencies, brands, studios, and commercial clients with digital imaging technician services, tethered capture, production workflow support, file management, color management, live RAW processing, secure backups, equipment support, post-production workflow, and live streaming production services.

3. Use of This Website

You may use this website for lawful informational, business, and inquiry-related purposes only.

​

You agree not to misuse this website, attempt unauthorized access, copy or scrape our content, submit false or misleading information, interfere with website performance, or use our brand name, images, language, service descriptions, or deliverables in a way that suggests unauthorized affiliation with PSco Studios.

​

We reserve the right to restrict access, refuse service, remove submissions, or take appropriate action if website use violates these Terms

4. Services, Proposals, and Agreements

Submitting a contact form, booking request, project inquiry, digital tech inquiry, or consultation request does not create a client relationship, confirmed booking, partnership, or service agreement.

​

A formal client relationship begins only when a written proposal, invoice, statement of work, contract, or service agreement has been reviewed and accepted by both parties.

​

Final project terms may include scope of work, deliverables, timeline, pricing, payment terms, usage rights, licensing terms, file handling, digital tech responsibilities, cancellation terms, travel requirements, site access responsibilities, safety requirements, confidentiality expectations, and project-specific limitations.

​

If there is a conflict between these website Terms and a signed agreement, the signed agreement will control for that specific project.

5. PSco Studios Responsibilities

PSco Studios agrees to perform services in a professional manner according to reasonable industry standards.

​

PSco Studios may use assistants, contractors, vendors, production partners, editors, drone operators, photographers, videographers, digital techs, project managers, or other team members as needed to complete the work.

​

PSco Studios will make reasonable efforts to complete the agreed scope of work; however, we cannot guarantee every requested image, angle, clip, shot, person, scene, construction condition, event moment, jobsite condition, milestone, digital workflow result, file transfer outcome, stream condition, or deliverable if affected by factors outside our control.

​

These factors may include weather, unsafe conditions, restricted access, event timing, site conditions, venue rules, owner restrictions, contractor restrictions, guest behavior, vendor interference, client delays, missing approvals, equipment restrictions, drone limitations, lighting conditions, schedule changes, network limitations, power availability, incompatible equipment, software issues, third-party platform issues, or other circumstances beyond PSco Studios’ control.

6. Exclusivity

For certain services, PSco Studios may require exclusivity as the primary or official photographer, videographer, creative production team, construction documentation provider, digital tech provider, or visual documentation partner for the contracted scope.

​

Guests, team members, internal staff, other vendors, or third parties may take photos or videos only if they do not interfere with PSco Studios’ ability to complete the work.

​

For construction projects, exclusivity may apply only to the agreed scope, such as progress documentation, milestone photography, drone coverage, closeout visuals, or proposal asset creation, unless otherwise stated in writing.

​

For Digital Tech Services, exclusivity may apply to the agreed technical workflow, capture station, file handling, backup workflow, live stream support, or production technology scope unless otherwise stated in writing.

7. Retainers, Deposits, and Booking Confirmation

An initial retainer, deposit, or first payment is required before any services are scheduled, reserved, or performed.

​

Unless otherwise stated in a written proposal or agreement, PSco Studios may require a 50% initial retainer and signed approval before work begins.

​

A project date, production date, event date, consultation, digital tech booking, site visit, or documentation schedule is not guaranteed until the required payment and written approval have been received.

​

Retainers compensate PSco Studios for reserving time, declining other work, administrative preparation, planning, scheduling, creative direction, production preparation, equipment preparation, technical planning, and other pre-service activities.

8. Contracted Scope and Package

The contracted service includes only the services, deliverables, dates, locations, usage rights, responsibilities, technical requirements, and file handling expectations described in the approved proposal, invoice, agreement, or selected package.

Services cannot be deducted after approval unless agreed in writing. Additional services may be added if approved by both parties and may require additional fees.

​

Additional services may include, but are not limited to:

  • Extra photography or video coverage

  • Additional site visits

  • Additional edits or revisions

  • Rush delivery

  • Drone or aerial coverage

  • Travel

  • Additional crew

  • Proposal support

  • Asset organization

  • File renaming or metadata support

  • Extended licensing

  • Additional final images or videos

  • Revisions outside the included scope

  • Reshoots not caused by PSco Studios

  • Construction documentation add-ons

  • Documentation system setup or onboarding

  • Additional digital tech support

  • Additional capture station setup

  • Additional backup drives or storage preparation

  • Live streaming add-ons

  • Post-production workflow support

  • Equipment rental support

  • Technical troubleshooting outside the agreed scope

9. Delivery Timeline

Delivery timelines will be outlined in the applicable proposal, agreement, or project scope.

​

Unless otherwise stated in writing, general delivery timelines may include:

​

  • Portraits and headshots: approximately 7 to 14 business days

  • Events: approximately 7 to 14 business days

  • Larger events, campaigns, or multi-day projects: approximately 14 to 30 business days

  • Construction progress documentation: according to the agreed reporting or delivery cadence

  • Video projects: based on project complexity, editing requirements, review cycles, and agreed timeline

  • Brand strategy, proposal, or creative production projects: according to the approved project schedule

  • Digital Tech Services: according to the agreed production schedule, file delivery plan, backup workflow, or technical support scope

  • Live streaming recordings or exports: according to the agreed platform, recording availability, and delivery workflow

​

Delivery timelines may be extended due to client delays, late approvals, missing information, project complexity, additional revisions, travel schedules, production volume, third-party delays, weather, site access issues, technical limitations, platform issues, file transfer delays, or force majeure events.

10. Expiration of Quotes and Proposed Dates

Quotes, proposals, session dates, production dates, digital tech holds, and project availability are time-sensitive.

​

Unless otherwise stated in writing, proposed dates or project holds may expire if not approved within 7 calendar days of issuance.

​

Pricing, availability, and proposed timelines are not guaranteed after expiration and may be subject to revision.

11. Style, Creative Direction, Technical Direction, and Professional Discretion

Client understands that they are hiring PSco Studios for its professional judgment, creative direction, technical skill, documentation approach, production style, visual storytelling expertise, and production workflow support.

​

PSco Studios may request a shot list, creative brief, brand guide, documentation checklist, project milestone list, production goals, technical brief, equipment list, file naming requirements, delivery expectations, or workflow requirements from the Client.

​

PSco Studios will make reasonable efforts to honor requested shots, scenes, milestones, priorities, workflow preferences, file handling needs, and technical expectations; however, not every item may be captured, completed, or delivered exactly as requested due to timing, access, safety, lighting, weather, participation, construction conditions, event flow, technical compatibility, power, network conditions, file size, platform limitations, or other unforeseen circumstances.

​

Client agrees that PSco Studios has discretion over artistic, technical, and production decisions, including composition, lighting, equipment, editing style, sequencing, image selection, capture method, file organization, folder structure, backup approach, monitoring setup, and final creative presentation.

​

Client dissatisfaction with style, subjective preference, or creative interpretation does not give the Client the right to rescind an approved agreement or avoid payment for completed work.

12. Build by PSco Studios Construction Documentation

Build by PSco Studios provides construction-related photography, video, drone, visual documentation, progress coverage, project storytelling, proposal support, closeout visuals, and related creative documentation services.

 

Services may support:

  • Pre-construction documentation

  • Existing condition photography or video

  • Construction progress documentation

  • Milestone-based visual coverage

  • Drone or aerial imagery, where permitted

  • Project storytelling and marketing assets

  • Stakeholder communication visuals

  • Proposal and qualifications imagery

  • Closeout visual records

  • Organized visual asset libraries

  • Visual documentation systems and onboarding

​

Unless specifically stated in a written agreement, our services do not replace licensed professional services, legal review, engineering review, surveying, site safety management, quality control authority, inspection services, insurance evaluation, contractor obligations, official project controls, or regulatory compliance responsibilities.

​

Clients remain responsible for all site access, safety protocols, permissions, approvals, owner requirements, contractor requirements, regulatory requirements, and project-specific compliance obligations.

13. Digital Tech / Henry Digitech Services

Henry Digitech / Digital Tech by PSco Studios provides production technology and digital imaging support for commercial photography, video production, brand shoots, studio productions, live events, and related creative projects.

 

Digital Tech Services may include:

  • Tethered capture support

  • Digital imaging technician services

  • Capture station setup

  • Camera-to-computer workflow support

  • File naming and folder structure setup

  • Metadata application

  • Focus and exposure monitoring

  • Live RAW processing and image review

  • Color management support

  • Backup workflow setup

  • Multiple-copy file protection workflows

  • Hardware and software troubleshooting

  • Equipment rental support

  • Post-production workflow support

  • Live streaming support

  • Production file delivery support

Digital Tech Services are intended to support capture workflow, production efficiency, file organization, review, backup, and delivery. Unless specifically stated in a written agreement, these services do not replace the responsibilities of the photographer, director, producer, agency, client, editor, retoucher, IT department, network provider, production company, equipment manufacturer, or platform provider.

14. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information needed for PSco Studios to perform the requested services.

​

This may include:

  • Project details

  • Contact information

  • Site access instructions

  • Brand guidelines

  • Shot lists

  • Safety requirements

  • Approval timelines

  • Required deliverable formats

  • Usage needs

  • Deadlines

  • Decision-maker availability

  • Special restrictions or confidentiality concerns

  • Technical requirements

  • File delivery expectations

  • Platform access, where applicable

  • Required permissions or approvals

PSco Studios is not responsible for delays, missed shots, incomplete documentation, incomplete workflow setup, technical limitations, reduced deliverable quality, or missed delivery expectations caused by inaccurate information, restricted access, late approvals, unsafe conditions, unavailable personnel, weather, incompatible systems, missing technical requirements, or circumstances outside our control.

15. Digital Tech Client Responsibilities

For Digital Tech Services, the Client is responsible for providing accurate information about the production, technical requirements, equipment, camera systems, software needs, file delivery expectations, network access, power availability, schedule, crew structure, and final usage needs.

​

Client may be responsible for confirming:

  • Camera systems and capture requirements

  • File format expectations

  • Naming conventions

  • Delivery requirements

  • Backup expectations

  • On-site power availability

  • Internet or network access, if needed

  • Monitor or review station needs

  • Client or agency approval workflow

  • Required software or system compatibility

  • Production schedule and shot list

  • Storage capacity requirements

  • Live streaming platform access, if applicable

  • Location restrictions or technical limitations

​

PSco Studios and Henry Digitech are not responsible for delays, workflow limitations, missing files, corrupted client-provided media, incompatible equipment, insufficient storage, lack of internet access, insufficient power, software licensing issues, camera limitations, manufacturer errors, third-party platform failures, or technical requirements not disclosed before the project.

16. Site Access, Safety, and Project Conditions

For construction, infrastructure, commercial, industrial, corporate, government, studio, live event, or active jobsite projects, the Client is responsible for providing safe, authorized, and timely access.

​

The Client may be responsible for providing:

  • Site entry approval

  • Safety orientation requirements

  • PPE requirements

  • Escort requirements

  • Parking instructions

  • Access instructions

  • Worksite restrictions

  • Restricted area information

  • Drone flight permissions

  • Owner or contractor approvals

  • Weather-related updates

  • Coordination with site managers, owners, or general contractors

  • Studio access details

  • Power access

  • Internet access

  • Equipment loading and staging information

  • Venue rules or restrictions

​

PSco Studios reserves the right to delay, pause, reschedule, or decline work if conditions are unsafe, access is restricted, required approvals are missing, or the requested work presents a safety, legal, operational, technical, or compliance concern.

17. Appropriate Conduct and Safe Working Environment

Client agrees to provide PSco Studios and its team with safe and appropriate working conditions.

​

PSco Studios reserves the right to pause, stop, reschedule, or leave a project, session, event, location, production, studio, stream setup, or jobsite if circumstances present an actual or implied threat of harm, harassment, unsafe conduct, illegal activity, severe illness exposure, weapons, violence, disorderly behavior, unsafe site conditions, restricted access, or risk to PSco Studios staff, contractors, equipment, files, data, or property.

​

If unsafe or inappropriate conduct occurs, PSco Studios may notify the Client or responsible party and allow a reasonable opportunity to correct the issue. If the issue is not corrected, or if the situation requires immediate action, PSco Studios may end coverage and leave the location.

​

If PSco Studios leaves due to unsafe or inappropriate conditions, the Client remains responsible for payment, and PSco Studios is not responsible for incomplete coverage, missed content, reduced deliverables, workflow disruption, streaming interruption, or any lapse in quality caused by those conditions.

18. Health and Safety

PSco Studios complies with applicable health and safety requirements and reserves the right to refuse any request that may be unsafe, illegal, unethical, or outside the agreed scope.

​

Client agrees not to request that PSco Studios or its team work in unsafe areas, violate site rules, ignore PPE requirements, bypass official access procedures, enter restricted locations without permission, operate near hazards without proper clearance, overload electrical systems, use unsafe network or power setups, or perform work that violates law, regulation, site policy, or professional judgment.

19. Drone and Aerial Services

Drone and aerial services are subject to weather, airspace restrictions, FAA rules, safety requirements, property permissions, site conditions, owner approvals, and project-specific restrictions.

​

Drone services are not guaranteed until airspace, safety, location, schedule, and operational conditions have been reviewed.

​

If drone coverage cannot be completed due to weather, airspace, access, safety, or legal restrictions outside our control, PSco Studios may recommend an alternate visual approach, adjusted schedule, or revised scope.

20. Live Streaming and Network-Dependent Services

Live streaming and other network-dependent services are subject to internet speed, network reliability, power availability, platform performance, venue restrictions, equipment compatibility, and third-party service availability.

​

PSco Studios and Henry Digitech will make reasonable efforts to support the agreed streaming or technical production scope; however, we cannot guarantee uninterrupted streaming, platform uptime, internet reliability, audience access, third-party platform performance, or error-free transmission.

​

Client is responsible for providing or approving any required platform access, passwords, stream keys, internet access, venue permissions, music rights, presentation rights, speaker permissions, or other approvals needed for live streaming or digital delivery.

​

If streaming or network-dependent services are interrupted due to internet failure, power failure, platform outage, venue restrictions, equipment supplied by others, or circumstances outside our control, PSco Studios and Henry Digitech are not responsible for lost viewers, missed content, reduced stream quality, or business impact.

21. Travel, Mileage, Lodging, and Destination Work

Travel requirements will be outlined in the applicable proposal, invoice, or agreement.

​

For services outside PSco Studios’ normal service area, additional fees may apply for mileage, travel time, lodging, airfare, rental vehicles, parking, tolls, meals, baggage, equipment transport, gear cases, production carts, hard drives, or other travel-related expenses.

​

Mileage may be billed at the current business mileage rate or at another rate stated in the approved agreement.

​

For destination or extended travel projects, Client may be responsible for reasonable lodging, transportation, and accommodations required for PSco Studios team members to perform the work safely and professionally.

​

All travel arrangements must be approved in writing.

22. Meals for Events and Extended Productions

For events, full-day productions, destination projects, digital tech bookings, construction documentation days, or extended coverage requiring PSco Studios team members to remain on site for an extended period, Client may be required to provide meals or reasonable meal breaks.

​

Meal requirements will depend on project length, schedule, location, and crew size.

​

If meals are not provided and coverage prevents the team from leaving the site, meal expenses may be billed to the Client.

23. Attire and Professional Presentation

PSco Studios team members will dress appropriately for the project, event, site, or production environment.

​

For corporate events, commercial productions, and formal settings, team members will generally wear professional or business-casual attire.

​

For construction sites, industrial locations, outdoor environments, drone work, or digital tech work requiring technical mobility, attire may include appropriate safety clothing, PPE, boots, high-visibility gear, production blacks, or other site-required clothing.

24. Overtime and Additional Services

Additional unplanned, uncontracted, or out-of-scope services may be billed as overtime or additional project work.

This may include:

​

  • Extended event coverage

  • Additional production hours

  • Additional site visits

  • Rush edits

  • Full redesigns

  • Re-edits outside the agreed revision cycle

  • Added documentation requests

  • Added deliverables

  • Same-day turnaround

  • Work outside the original scope

  • Additional project management

  • Client-requested reshoots

  • Management of non-production activities

  • Additional digital tech hours

  • Additional backup or file delivery requests

  • Streaming extensions

  • Additional equipment setup

  • Software or hardware troubleshooting outside the agreed scope

​

Unless otherwise stated in writing, overtime or out-of-scope work may be billed at $250 per hour for creative, production, event, construction documentation, and digital tech services.

​

Specialized strategy, consulting, construction documentation systems, proposal support, drone operations, live streaming, production technology, or executive-level creative direction may be billed at a higher rate if stated in the approved proposal or agreement.

25. Reimbursable Costs and Purchased Items

Drone and aerial services are subject to weather, airspace restrictions, FAA rules, safety requirements, property permissions, site conditions, owner approvals, and project-specific restrictions.

​

Drone services are not guaranteed until airspace, safety, location, schedule, and operational conditions have been reviewed.

​

If drone coverage cannot be completed due to weather, airspace, access, safety, or legal restrictions outside our control, PSco Studios may recommend an alternate visual approach, adjusted schedule, or revised scope.

26. Contracted Vendors, Rentals, and Third-Party Payments

If PSco Studios contracts or coordinates rentals, subcontractors, vendors, locations, equipment, software, specialty operators, assistants, digital tech equipment, production technology, or production partners on behalf of the Client, the Client remains responsible for all approved costs and payment deadlines.

​

Third-party vendors may have their own terms, cancellation policies, insurance requirements, usage restrictions, warranty limitations, and technical requirements.

​

PSco Studios is not responsible for delays, errors, service failures, equipment

failures, cancellation terms, platform issues, software issues, or performance issues caused by third-party vendors outside our control.

27. Damage or Loss of Equipment, Rentals, or Property

Client agrees to exercise reasonable care around PSco Studios equipment, rentals, props, accessories, files, storage devices, lighting, camera equipment, drone equipment, production tools, computers, monitors, drives, cables, capture stations, networking equipment, card readers, streaming equipment, carts, cases, and other property.

​

Client may be responsible for repair or replacement costs if damage, loss, theft, or destruction is caused by the Client, Client’s guests, employees, contractors, invitees, representatives, site personnel, venue personnel, or other parties under Client’s control.

​

For Digital Tech Services, this also applies to computers, monitors, drives, cables, capture stations, networking equipment, storage devices, card readers, streaming equipment, carts, cases, rented production equipment, and other technology or accessories used during the project.

28. Payment Schedule and Payment Methods

Payment schedules are determined by the applicable proposal, invoice, agreement, or statement of work.

​

Unless otherwise stated in writing, payment may be structured as:

  • 50% retainer due upon approval

  • Remaining balance due before the job date, delivery date, or agreed milestone

  • Monthly retainer billing for ongoing services

  • Milestone payments for larger projects

  • Payment before release of final files or deliverables

​

Accepted payment methods may include credit card, ACH transfer, Zelle, or other approved payment methods.

​

A booking, production date, documentation visit, digital tech booking, event date, or project start may not be confirmed until required payment and written approval are received.

29. Late Payments and Withholding of Deliverables

PSco Studios may pause services, delay delivery, withhold final files, suspend access to galleries or project folders, pause file transfers, suspend live stream setup, delay release of documentation, or stop work on active projects if payment is late, declined, disputed, incomplete, or not received according to the agreed payment schedule.

​

Late payment fees may apply if stated in the invoice, proposal, or agreement.

​

Client remains responsible for all approved services, completed work, purchased items, third-party costs, and agreed project fees.

30. Cancellations

If a project, event, session, production, digital tech booking, live stream, or documentation visit is postponed, PSco Studios may apply previously paid amounts to a new date if available.

​

New dates are subject to availability and may require a revised payment schedule, updated scope, or additional fees.

​

If no new date is provided, PSco Studios may pause all services until a new date is confirmed.

​

If services must resume before a new project or event date is confirmed, additional payment may be required.

31. Postponements and Rescheduling

If a project, event, session, production, digital tech booking, live stream, or documentation visit is postponed, PSco Studios may apply previously paid amounts to a new date if available.

​

New dates are subject to availability and may require a revised payment schedule, updated scope, or additional fees.

​

If no new date is provided, PSco Studios may pause all services until a new date is confirmed.

​

If services must resume before a new project or event date is confirmed, additional payment may be required.

32. Force Majeure

PSco Studios is not liable for failure or delay in performance caused by events beyond its reasonable control.

Force majeure events may include acts of God, natural disasters, hurricanes, flooding, fires, explosions, severe weather, pandemics, epidemics, illness, war, terrorism, civil unrest, strikes, labor disruptions, government orders, site shutdowns, power outages, transportation failures, supply shortages, equipment restrictions, airspace restrictions, unsafe conditions, network outages, platform outages, internet failures, power failures, or other circumstances beyond PSco Studios’ control.

If a force majeure event affects performance, PSco Studios will make reasonable efforts to communicate with the Client and resume services when reasonably possible.

​

Payments, retainers, and deposits may remain non-refundable, but PSco Studios may offer rescheduling, credit, or adjusted scope at its discretion or as stated in the applicable agreement.

33. Failure to Perform Services

If PSco Studios is unable to perform all or part of the agreed services due to illness, emergency, equipment failure, technical failure, unavoidable conflict, or another serious issue, PSco Studios will make reasonable efforts to notify the Client as soon as possible.

When appropriate and available, PSco Studios may attempt to provide a competent replacement professional, subcontractor, digital tech, production partner, or team member with Client approval.

​

If no reasonable replacement is available and PSco Studios cannot perform the work, PSco Studios may issue a refund or credit based on the portion of services not rendered.

​

Refunds, if applicable, will be limited to the reasonably accurate value of services not performed and will not include indirect, consequential, or special damages.

34. Copyright and Ownership

Unless otherwise stated in writing, PSco Studios retains copyright ownership of all Images, Videos, Creative Assets, designs, written content, edits, concepts, raw files, working files, production files, and deliverables created by PSco Studios.

Client receives only the usage rights or license specifically granted in the approved proposal, agreement, invoice, or statement of work.

No copyright, ownership, or property rights transfer to the Client unless expressly stated in writing.

PSco Studios asserts its right to be identified as the author, creator, photographer, videographer, agency, or production company responsible for the work where appropriate.

For Digital Tech Services, PSco Studios and Henry Digitech do not claim copyright ownership over client-owned images, videos, footage, brand assets, or production files created by another photographer, videographer, agency, client, or production company unless PSco Studios directly created those assets. However, any original workflow documents, file structures, templates, processes, written materials, creative edits, production systems, or custom deliverables created by PSco Studios or Henry Digitech remain the intellectual property of PSco Studios unless otherwise stated in writing.

35. Usage Rights and Licensing

Client may use delivered assets only according to the usage rights granted in the applicable agreement.

Usage rights may define:

  • Personal use

  • Internal business use

  • Website use

  • Social media use

  • Proposal use

  • Portfolio use

  • Advertising use

  • Commercial use

  • Editorial use

  • Print use

  • Geographic limits

  • Time limits

  • Third-party sharing

  • Paid media use

  • Resale or sublicensing restrictions

Any sale, publication for profit, paid advertising use, resale, sublicensing, transfer to third parties, or use outside the granted license requires written permission from PSco Studios and may require additional licensing fees.

​

If Client uses PSco Studios work beyond the granted rights, Client may be responsible for additional licensing fees, damages, legal fees, and enforcement costs.

36. Credit Line and Copyright Notice

When credit is required or appropriate, Client should credit PSco Studios as agreed in writing.

If a required copyright notice or credit line is omitted, PSco Studios may require correction or charge an additional fee.

​

Unless otherwise agreed in writing, omission of a required credit line may result in a fee increase of not less than 25% of the applicable licensing or usage fee.

37. Raw Files, Working Files, and Source Files

Raw files, unedited files, camera originals, video footage, design source files, editing timelines, project files, internal notes, drafts, alternate takes, and working files are not included unless specifically stated in writing.

If raw files, working files, or source files are requested and approved, additional fees, licensing restrictions, file preparation charges, or release terms may apply.

​

For Digital Tech Services, raw files, capture files, camera originals, backup copies, session folders, processed files, exported files, or live stream recordings may only be delivered according to the agreed scope. Long-term storage, archive management, re-delivery, file recovery, drive preparation, or post-project file handling may require additional fees.

38. File Management, Backups, and Data Handling

PSco Studios and Henry Digitech may assist with file organization, backup workflows, storage structure, delivery preparation, and production file management.

​

While reasonable care is taken when handling files, no digital workflow, storage device, transfer method, software platform, or backup system can be guaranteed to be completely free from error, corruption, failure, loss, or interruption.

Unless otherwise stated in writing, Client remains responsible for maintaining its own copies of important files, final deliverables, source materials, brand assets, production files, and archived project materials.

​

For Digital Tech Services, PSco Studios and Henry Digitech may recommend backup workflows, duplicate storage, naming systems, and file management processes; however, Client is responsible for approving the workflow and maintaining long-term file storage after delivery.

​

PSco Studios and Henry Digitech are not responsible for file loss, corruption, accidental deletion, failed transfers, storage device failure, software errors, or third-party platform issues caused by equipment, systems, platforms, or materials outside our control.

39. Client Images, Media, and Approved Materials

Client represents that it has the right to provide any logos, images, videos, music, documents, brand assets, property access, likenesses, trademarks, project files, construction plans, technical requirements, platform credentials, stream materials, or other materials submitted to PSco Studios.

Client is responsible for securing any permissions, releases, licenses, approvals, or consents required for materials, locations, people, brands, intellectual property, music, presentations, platforms, construction documents, or project information provided to PSco Studios.

​

Client agrees to hold PSco Studios harmless from claims related to unauthorized materials, locations, property, people, trademarks, copyrighted works, confidential information, platform access, or project information supplied or approved by Client.

40. Portfolio, Marketing, and Case Study Use

Unless restricted by written agreement, PSco Studios may use selected approved work for portfolio, website, social media, proposals, case studies, presentations, award submissions, or marketing purposes.

For sensitive, confidential, active construction, private corporate, government, restricted-access, unreleased campaign, production, or digital tech projects, portfolio or public-facing use may require written Client approval before publication.

41. No Guarantee of Specific Results

PSco Studios works to provide high-quality creative, documentation, strategy, production, and digital tech services.

​

However, PSco Studios does not guarantee specific business outcomes, sales results, contract awards, proposal wins, revenue increases, search rankings, social media engagement, legal outcomes, insurance outcomes, construction dispute outcomes, project performance results, streaming audience numbers, platform performance, file recovery outcomes, or production results outside the agreed scope.

Any examples, case studies, testimonials, or performance references are for informational purposes and do not guarantee similar results.

42. Third-Party Platforms and Tools

PSco Studios may use third-party platforms to support website hosting, scheduling, client communication, CRM, invoicing, payment processing, analytics, email marketing, project management, file storage, gallery delivery, proofing, editing, live streaming, capture workflow, production monitoring, backup, and digital asset delivery.

PSco Studios is not responsible for outages, errors, policy changes, data loss, service interruptions, payment delays, access issues, platform failures, stream interruptions, file transfer failures, or technical limitations caused by third-party platforms outside our control.

These services do not replace legal review, licensed professional services, engineering review, surveying, safety responsibilities, insurance requirements, contractor obligations, quality control authority, or official project controls unless expressly stated in a written agreement.

For Henry Digitech / Digital Tech by PSco Studios, digital imaging, tethered capture, file management, backup workflow, color management, equipment support, post-production workflow, and live streaming services are intended to support production efficiency and technical workflow. These services do not replace the responsibilities of the photographer, director, producer, editor, retoucher, IT provider, platform provider, equipment manufacturer, network provider, or client unless expressly stated in a written agreement.

45. Limitation of Liability

PSco Studios is only liable for services completed and provided by PSco Studios.

PSco Studios is not responsible for the actions, omissions, delays, errors, failures, or services of other vendors, contractors, venues, guests, project teams, site personnel, government agencies, property owners, third-party platforms, equipment manufacturers, software providers, network providers, or subcontractors outside PSco Studios’ control.

​

To the fullest extent permitted by law, PSco Studios shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost opportunities, lost contracts, lost data, lost files, business interruption, production interruption, project delays, reputational harm, or reduced project performance.

​

PSco Studios’ total liability for any claim will be limited to the amount paid by Client to PSco Studios for the specific service giving rise to the claim, unless otherwise required by law or stated in a written agreement.

For Digital Tech Services, PSco Studios and Henry Digitech are not liable for indirect, incidental, consequential, or special damages related to file loss, file corruption, software failure, hardware failure, storage device failure, internet failure, power failure, streaming interruption, platform outage, incompatible equipment, delayed delivery, missed shots, lost profits, lost usage, lost opportunities, or production delays caused by factors outside our control.

46. Indemnification

Client agrees to indemnify and hold harmless PSco Studios, its owners, team members, contractors, partners, vendors, and representatives from claims, damages, losses, liabilities, costs, or expenses arising from:

  • Client’s misuse of this website

  • Client’s violation of these Terms

  • Information or materials submitted by Client

  • Unauthorized use of PSco Studios content or deliverables

  • Project access issues caused by inaccurate or incomplete information

  • Third-party claims related to materials, permissions, locations, trademarks, people, property, music, platforms, technical systems, or project information provided or approved by Client

  • Unsafe conditions, restricted access, or conduct by Client-controlled parties

  • Client’s breach of any applicable agreement or legal obligation

  • Client-provided equipment, platforms, software, credentials, data, files, storage devices, or technical systems

47. Attorney’s Fees

If legal action is necessary to enforce these Terms, an invoice, a proposal, a licensing agreement, or a client agreement, the prevailing party may be entitled to recover reasonable attorney’s fees, court costs, collection costs, and other remedies available by law or contract.

48. Governing Law

Unless otherwise stated in a written agreement, these Terms are governed by the laws of the State of Florida.

Any disputes related to these Terms, this website, or services provided by PSco Studios will be handled according to the applicable written agreement, or if no written agreement applies, through an appropriate venue in Florida.
